Pregnant Woman Uses HOV Lane - Says She Should Count As Two People

A Plano, Texas woman was speeding to pick her son up from school when she was pulled over. She was asked why she was using a high occupancy vehicle lane by the officer, and she explained that she was 34 weeks pregnant, so her unborn girl counted as a person after the overturning of Roe v. Wade. The officer reportedly responded with “Oh no. It’s got to be two people outside of the body.”

The Texas penal code recognizes an unborn child as a person, but the Texas Transportation Code doesn’t, and since an unborn child doesn’t take up an extra seat, they can’t help meet the requirement to use the HOV lane. The woman plans to fight the ticket in court.
